Welcome to Art By Caid. These Terms of Service (“Terms”) govern your access to and use of our website, www.artbycaid.com, and your purchase of products offered through our online store.

By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

1. Our Products

We offer original artwork, prints, canvas reproductions, and other art-related products.

Some products are original, one-of-a-kind works of art created by the artist. Other products are made-to-order or print-on-demand products produced locally through independent third-party production partners.

The use of third-party production partners does not transfer ownership of our artwork or intellectual property rights to those partners or to customers.

2. Original Artwork

Each original artwork is unique and one-of-a-kind. The physical artwork purchased by a customer is sold as a finished piece, but the purchase does not transfer copyright, reproduction rights, or other intellectual-property rights in the artwork.

Unless expressly authorized in writing, customers may not reproduce, copy, distribute, modify, commercially exploit, or create derivative works from any artwork purchased from our store.

3. Made-to-Order and Print-on-Demand Products

Certain products are manufactured specifically after an order is placed.

These products are produced locally through third-party vendors selected by us. Because these products are made specifically for each order, production times may vary.

We reserve the right to use, change, or replace production partners when reasonably necessary to fulfill an order while maintaining the intended quality and specifications of the product.

4. Product Descriptions and Images

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colors, and other information displayed on our website are accurate.

However, colors may appear differently depending on your monitor, phone, tablet, lighting, or other display settings.

Original artwork may contain natural variations in color, texture, brushwork, and surface characteristics. Such variations are part of the nature of original artwork and are not necessarily defects.

We reserve the right to correct typographical errors, inaccuracies, omissions, pricing errors, or other errors on our website at any time.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase the products selected.

We reserve the right to accept, decline, or cancel an order for legitimate reasons, including product availability, pricing errors, payment issues, suspected fraud, shipping restrictions, production limitations, or inaccurate customer information.

If we cancel an order after payment has been processed, we will issue a refund for the amount paid for the cancelled order.

6. Pricing and Payment

Prices are displayed on our website in the applicable currency and may change without notice.

The price applicable to an order is the price displayed at the time the order is placed, except in cases of obvious pricing or listing errors.

You authorize us and our payment processors to charge your selected payment method for the total amount of your order, including applicable taxes and shipping charges.

7. Shipping and Delivery

Shipping and delivery estimates provided on our website are estimates only and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs authorities, weather, natural disasters, government actions, transportation disruptions, incorrect shipping information, or other circumstances beyond our reasonable control.

Customers are responsible for providing an accurate and complete shipping address.

8. International Orders and Customs

International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country.

Unless otherwise stated at checkout, all such charges are the responsibility of the customer.

Qualifying original artwork may be classified under HS Code 9701.10. However, this classification does not automatically apply to all artwork, canvas products, or print-on-demand products. Different products may require different tariff classifications.

The final determination of tariff classification, customs duties, taxes, and import requirements is made by the applicable customs authority.

Providing an HS code does not guarantee duty-free or tax-free entry into any country.

9. Returns and Refunds

Returns, refunds, cancellations, damaged products, and defective products are governed by our Return & Refund Policy.

By purchasing from our store, you acknowledge that original artwork and made-to-order products may be subject to different return conditions.

Nothing in these Terms is intended to exclude or limit any consumer rights that cannot legally be excluded or limited under applicable law.

10. Intellectual Property

All artwork, photographs, images, graphics, logos, designs, written content, videos, product descriptions, and other materials displayed on this website are owned by or licensed to Art By Caid, unless otherwise indicated.

These materials are protected by copyright, trademark, and other applicable intellectual-property laws.

Purchasing a physical artwork or product does not transfer copyright or other intellectual-property rights to the purchaser.

Without our prior written permission, you may not:

• Copy or reproduce our artwork;

• Scan, photograph, or digitally reproduce artwork for commercial use;

• Create derivative works;

• Resell reproductions;

• Use artwork in merchandise;

• Use artwork in NFTs or other digital assets;

• Remove copyright or ownership notices;

• Use our artwork for commercial advertising or branding; or

• Use our artwork to train or develop artificial-intelligence or machine-learning systems.

11. Website Use

You agree to use our website only for lawful purposes.

You may not use our website to:

• Commit fraud or engage in unlawful activity;

• Attempt to gain unauthorized access to our systems;

• Interfere with the operation or security of the website;

• Upload malicious software or code;

• Scrape or copy website content for unauthorized commercial purposes;

• Impersonate another person or business; or

• Infringe the rights of another person or business.

We reserve the right to restrict or terminate access to our website where reasonably necessary.
